Welcome to PokePicks. By accessing our website (pokepicks.com) or downloading and using our desktop application, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please do not use our services.
1. Description of Service
PokePicks is a desktop application and website that helps Pokémon card collectors find deals on eBay, track market prices, set up alerts for specific cards, and analyze card grading potential. PokePicks searches publicly available eBay listings and provides market data from third-party sources including TCGPlayer.
2. Acceptable Use
You agree to use PokePicks only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the application to engage in any form of market manipulation or fraudulent activity
- Attempt to reverse-engineer, decompile, or disassemble the application
- Redistribute, resell, or share your download link with others
- Use automated tools, bots, or scripts to interact with our website or application beyond normal usage
- Attempt to bypass download limits, token restrictions, or other security measures
- Use the application in any way that could damage, disable, or impair our services
3. Account & Download Access
To download PokePicks, you must provide a valid email address through our signup form. You will receive a secure, tokenized download link that is limited to 3 downloads and expires after 72 hours. Each download link is intended for personal use only. If you need a new link, you can sign up again with the same email address.
4. Intellectual Property
All content, features, and functionality of the PokePicks application and website — including but not limited to text, graphics, logos, icons, and software — are the property of PokePicks and are protected by copyright and other intellectual property laws. "Pokémon" is a trademark of The Pokémon Company, Nintendo, and Creatures Inc. PokePicks is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, eBay, or TCGPlayer.
5. Affiliate Disclosure
PokePicks participates in affiliate programs with eBay and TCGPlayer. When you click on links within our application that direct you to these platforms and complete a purchase, we may earn a commission at no additional cost to you. This affiliate relationship does not influence the listings, prices, or data displayed within our application.
6. Accuracy of Information
PokePicks displays pricing and market data sourced from eBay, TCGPlayer, and other third-party providers. While we strive to present accurate information, we do not guarantee the accuracy, completeness, or timeliness of any data displayed. Card prices fluctuate, and the information shown should be used as a reference only. Always verify pricing directly on the selling platform before making purchasing decisions.
7. Card Grade Estimates
The Card Grade feature provides estimated PSA grades based on centering analysis of uploaded card photos. These estimates are for informational purposes only and are not a substitute for professional grading services. PokePicks does not guarantee any specific grade outcome from PSA, CGC, or any other grading company.
8. No Warranty
PokePicks is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the application will be error-free, uninterrupted, or free of viruses or other harmful components. Your use of the application is at your sole risk.
9. Limitation of Liability
To the fullest extent permitted by law, PokePicks and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the application or website. This includes, but is not limited to, damages for lost profits, missed deals, or purchasing decisions made based on data provided by the application.
10. Updates & Changes
We may update the PokePicks application, website, or these Terms of Use at any time without prior notice. Continued use of our services after changes constitutes your acceptance of the revised terms. We recommend checking this page periodically for updates.
11. Termination
We reserve the right to restrict or terminate your access to PokePicks at our discretion if we believe you are violating these Terms of Use or engaging in behavior that could harm our services or other users.
